- School districts must ensure non-discrimination based on race, color, or national origin and ensure that a student’s citizenship or immigration status, or that of their parents or guardians, does not hinder their enrollment in public elementary and secondary schools.
- Additionally, school districts are prohibited from seeking information with the intent of denying access to public schools based on race, color, or national origin.
- Residency document requirements should be carefully reviewed to prevent any unlawfully discriminatory barriers for undocumented students or those with undocumented parents.
- Lack of a birth certificate or foreign place of birth in records, such as a foreign birth certificate, should not be grounds for denying a student enrollment in school.
- The information collected by school districts regarding race, ethnicity, national origin, or English proficiency must not be used for discriminatory purposes. A parent or guardian’s refusal to provide such data should not result in a denial of a child’s enrollment.
- Enrollment cannot be denied if a student (or their parent or guardian) chooses not to provide a Social Security number. If a Social Security number is requested, the district must inform the individual that disclosure is voluntary, provide the legal basis for seeking the number, and clarify its intended uses.
