DESCRIPTION:School districts must ensure non-discrimination based on race\, color\, or national origin and ensure that a student’s citizenship or immigration status\, or that of their parents or guardians\, does not hinder their enrollment in public elementary and secondary schools.\nAdditionally\, school districts are prohibited from seeking information with the intent of denying access to public schools based on race\, color\, or national origin.\nResidency document requirements should be carefully reviewed to prevent any unlawfully discriminatory barriers for undocumented students or those with undocumented parents.\nLack of a birth certificate or foreign place of birth in records\, such as a foreign birth certificate\, should not be grounds for denying a student enrollment in school.\nThe information collected by school districts regarding race\, ethnicity\, national origin\, or English proficiency must not be used for discriminatory purposes. A parent or guardian’s refusal to provide such data should not result in a denial of a child’s enrollment.\nEnrollment cannot be denied if a student (or their parent or guardian) chooses not to provide a Social Security number. If a Social Security number is requested\, the district must inform the individual that disclosure is voluntary\, provide the legal basis for seeking the number\, and clarify its intended uses.\n\n
